Terms of Service

1. Legal Entity

These Terms of Service (“Terms”) are entered into by and between you and EmpowHER AI, LLC d.b.a. EndoCare Health Co. (“EndoCare,” “we,” “us,” or “our”).

2. Nature of Services

EndoCare™ is a brand and ordering facilitation platform designed to support informed, patient-centered dialogue through at-home laboratory testing coordination. EndoCare does not provide medical care, diagnosis, treatment, or telehealth services.

3. Role of EndoCare Health Co.

Laboratory kit fulfillment, physician authorization, laboratory testing, and results portal services are provided by independent third-party partners, including SpotDx. EndoCare Health Co. does not access, host, store, or process laboratory test results or protected health information. EndoCare does not establish a physician-patient relationship.

4. Community Content

You are solely responsible for any content you voluntarily submit to the EndoCare community or public-facing portions of the website. You agree not to post medical records, laboratory results, identification numbers, or sensitive personal or health information. EndoCare reserves the right to remove or moderate content that violates these Terms.

Community content is for peer support and informational purposes only and does not constitute medical advice.

5. Payment & Orders

EndoCare facilitates ordering of third-party laboratory services. Payment processing is handled by secure third-party processors. EndoCare does not control laboratory operations.

6. Limitation of Liability

To the fullest extent permitted by law, EndoCare shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service. Total liability shall not exceed the amount paid for the applicable order.

7. Indemnification

You agree to indemnify and hold harmless EndoCare from claims arising from your misuse of the Service or violation of these Terms.

8. Governing Law

These Terms shall be governed by the laws of the State of North Carolina.

9. Binding Arbitration

Any dispute arising out of or relating to these Terms shall be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall occur exclusively in Wake County, North Carolina.

Arbitration shall be conducted on an individual basis only. Class, collective, or representative actions are waived.
